By accessing or using the website located at masonryconway.com (the "Site"), or by engaging Conway Masonry & Concrete ("we," "our," or "us") for any services, you agree to be bound by these Terms and Conditions. Please read them carefully before using the Site or requesting services.
If you do not agree to these Terms, do not use the Site or engage our services. We reserve the right to update these Terms at any time. Continued use of the Site after changes are posted means you accept the updated Terms.
Conway Masonry & Concrete provides masonry and concrete contracting services in Conway,AR and surrounding areas. Our services include, but are not limited to, foundation repair, chimney repair, tuckpointing, brick repair, retaining wall construction, fireplace installation, stone veneer installation, driveway paver installation, walkway construction, and related masonry work.
All services are performed at the property address specified in a written estimate or service agreement. We reserve the right to decline any project request at our discretion.
Estimates provided verbally, by email, or through our website contact form are preliminary and not binding until confirmed in a written, signed agreement. Written estimates are valid for 30 days from the date of issuance unless otherwise stated.
Prices in a written estimate are based on the scope of work described at the time of the estimate. If conditions at the job site differ materially from what was observed or described - such as hidden damage, structural complications, or changes in the scope of work requested by the customer - we reserve the right to adjust pricing with written notice before proceeding with additional work.
We are not responsible for cost discrepancies resulting from information provided inaccurately by the customer prior to the estimate.
Once a written agreement is signed and a deposit (if required) is received, a start date will be scheduled. We will notify you of any changes to the scheduled date as soon as possible.
If you need to cancel or reschedule a confirmed project, please contact us at least 48 hours in advance. Cancellations with less than 48 hours notice may result in forfeiture of any scheduling deposit paid to reserve the date.
We reserve the right to reschedule work due to weather conditions, material delays, or other circumstances beyond our reasonable control. We will communicate any such changes promptly.
Payment terms are specified in the written estimate or service agreement for each project. Unless otherwise agreed in writing, final payment is due upon completion of the work. For larger projects, a deposit may be required before work begins, with the balance due at completion.
Accepted payment methods will be communicated at the time of agreement. Payments not received within 30 days of the invoice date may be subject to a late fee of 1.5% per month on the outstanding balance, or the maximum rate permitted by Arkansas law, whichever is less.
In the event of non-payment, we reserve the right to pursue all available legal remedies, including filing a mechanics lien on the property where permitted by Arkansas law. The customer is responsible for any reasonable attorneys fees and collection costs incurred in recovering an unpaid balance.
We stand behind our workmanship. Any specific warranty terms - including duration and what is covered - will be stated in the written service agreement for your project. In the absence of a written warranty, the following applies:
THE SITE AND ANY CONTENT ON IT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, COMPLETENESS, OR FITNESS FOR A PARTICULAR PURPOSE OF ANY INFORMATION ON THIS SITE.
Warranties for completed work do not cover damage caused by subsequent homeowner modifications, acts of nature, flooding, or conditions outside the scope of the original project. Normal wear and maintenance are the responsibility of the property owner.
To the fullest extent permitted by applicable law, Conway Masonry & Concrete shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, any services we provide, or any content or materials on the Site.
Our total liability to you for any claim arising out of a project or service shall not exceed the amount you paid us for that specific project. This limitation applies regardless of the legal theory under which the claim is brought.
You agree to provide accurate information when requesting an estimate or service. You are responsible for ensuring that our crew has safe, legal access to the work area on the scheduled service date.
If permits are required for your project, we will communicate that clearly in the written estimate. Costs for permits are typically included in the project price unless stated otherwise. You agree to cooperate with any required inspections and to maintain the work area in a safe condition before and during work.
If a dispute arises between you and Conway Masonry & Concrete related to services rendered or these Terms, we encourage you to contact us first so we can try to resolve it directly. Please reach out to us at info@masonryconway.com with a description of the issue.
If direct resolution is not possible, either party may pursue resolution through binding arbitration in Faulkner County, Arkansas, under the rules of the American Arbitration Association, or through the appropriate state or local court in Arkansas.
You agree that any claim must be brought on an individual basis and not as part of a class action or consolidated proceeding.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict-of-law provisions. Any legal action arising from these Terms or your use of our services shall be brought exclusively in the state or federal courts located in Faulkner County, Arkansas.
